Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the websites, games, and other services provided by Triple Kong, LLC (“Triple Kong,” “we,” “us,” or “our”), including triplekong.com, DailyMahJongg.com, and our mobile apps (collectively, the “Services”). Please read them carefully.
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you are under the age of majority, you must have permission from a parent or legal guardian. By using the Services, you represent that you meet these requirements.
2. License to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. We reserve all rights not expressly granted.
3. Accounts
Some features may require an account. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. Acceptable use
You agree not to:
- Use the Services in violation of any applicable law.
- Cheat, exploit bugs, use unauthorized automation, or otherwise interfere with fair play or the intended operation of the Services.
- Reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
- Upload or transmit malware, or attempt to gain unauthorized access to our systems or other users’ accounts.
- Harass, abuse, or harm others, or post unlawful, infringing, or objectionable content.
- Copy, distribute, or create derivative works from the Services except as expressly permitted.
5. Subscriptions and in-game scoring
Subscriptions
Some features of the Services may be offered through a paid subscription. Subscriptions are sold and processed through the applicable app store (such as the Apple App Store or Google Play) and are subject to that store’s terms and payment policies. Unless otherwise stated at the point of purchase, subscriptions renew automatically at the then-current price until cancelled, and your account will be charged for renewal within the window specified by the app store before the end of the current period. You can manage or cancel a subscription at any time through your app store account settings; cancellation takes effect at the end of the current billing period. Refunds are handled by the app store in accordance with its policies, except where a refund is required by applicable law.
In-game scoring and coins
Our games keep a running score of your play, which may be displayed as coins, chips, or a similar tally. This score is a scorekeeping device only. It has no real-world monetary value, is not currency, and cannot be purchased, sold, transferred, exchanged, redeemed, withdrawn, or cashed out for money or anything of value. Amounts won or lost are determined by the fixed value of the hand played under the applicable rules — players do not place bets or wagers and cannot set or alter the amount at stake. Your score does not constitute gambling, a wager, or a prize, and we may adjust or reset scores as needed to operate the Services.
6. Intellectual property
The Services, including all software, artwork, logos, text, and other content, are owned by Triple Kong or its licensors and are protected by intellectual property laws. “Triple Kong” and our game names and logos are our trademarks. You may not use them without our prior written permission.
7. Third-party services and links
The Services may contain links to, or integrate with, third-party websites and services (including the app stores and advertising partners). We are not responsible for the content or practices of those third parties, and your use of them is governed by their own terms.
8. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
9. Limitation of liability
To the fullest extent permitted by law, Triple Kong and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.
10. Indemnification
You agree to indemnify and hold harmless Triple Kong from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or to protect the Services or other users. You may stop using the Services at any time.
12. Governing law
These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws principles. You agree that any dispute will be resolved in the state or federal courts located in North Carolina, except where prohibited by applicable law.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
